AGLC4 Rule 11.1.1: State-State Decisions: Reported Decisions

Reported decisions between states are cited much as ICJ decisions under rule 10.2, but the parties are always given in their conventional short form, a date in the phase is kept only where needed to identify the decision, and the year, volume, series and starting page follow the rules for reported cases. Arbitrators are named only after pinpoints to separate or dissenting opinions or declarations. Modern awards are widely available, so a report need be cited only where the decision is hard to find or there is good reason.

Formatting

  • The case name follows rule 10.2.1 and is italic.
  • The parties are italic, in italic round brackets, separated by an italic v, always in the conventional short form.
  • Parallel or joined proceedings name only the first listed parties.
  • The phase is italic in italic round brackets, as stated on the decision, and may be long and descriptive; a date in it is dropped unless needed to identify the decision.
  • Year, volume and report series follow rules 2.2.1 to 2.2.3: a volume organised series takes the year in round brackets, then the volume and the series abbreviation, all roman.
  • The starting page follows after a single space (rule 2.2.4), then a comma and the pinpoint (rule 10.2.7).
  • Issue numbers are not given.
  • An arbitrator's name follows the pinpoint in round brackets only for a separate or dissenting opinion or declaration, and titles other than Mr or Ms, such as Dr or Prof, may be used.
  • An otherwise unreported decision that appears in ILM is cited to ILM.
