AGLC4 Rule 14.3.1: Basic Documents of the Council of Europe

The Statute of the Council of Europe and the European Convention on Human Rights are cited in the fixed chapter 8 forms set out in the rule, the Convention being followed by as amended by and the relevant amending protocol. Substantive protocols are cited with their amendments in the same way, and amending protocols are cited under chapter 8 with the ETS or CETS as the treaty series where available.

Formatting

  • Both fixed citations use the chapter 8 layout: italic title, comma, opened for signature and the date, comma, UNTS citation, entry into force in round brackets.
  • For the Convention and substantive protocols, a comma follows the entry into force bracket, then as amended by in roman lower case, then the full citation of the amending protocol.
  • The amending protocol takes the chapter 8 form, with the European Treaty Series or Council of Europe Treaty Series as the treaty series where available.
  • ETS and CETS citations are the series abbreviation, No and the treaty number, roman, with no full stops.
  • The ETS runs to No 193; from 2004 (No 194) the series is the CETS.
