AGLC4 Rule 14.2.2: Constitutive Treaties of the European Union

EU and EC founding treaties are cited as treaties under chapter 8, except that an OJ citation replaces the UNTS or national series where available and a short title or amendment details are added. A treaty cited as currently in force takes the latest consolidated OJ version and the short title for current references; a treaty cited as originally made takes the UNTS or OJ version as made and the short title for historical references. Amendment details may be added with as amended by, and the signature and entry into force dates are always those of the treaty as made.

Formatting

  • The OJ citation, in the form year in square brackets, OJ, series, issue number, unspaced slash, starting page, takes the place of the treaty series, between the signature date and the entry into force brackets.
  • A treaty cited as in force uses the latest OJ consolidation and the short title for current references from the table.
  • A treaty cited historically uses the UNTS or OJ that contains it as made and the short title for historical references from the table.
  • The short title is italic, inside curly single quotation marks, inside round brackets, at the end of the first citation, and is used for later references.
  • Signature and entry into force dates are those of the treaty as originally made, whichever version is cited.
  • A treaty that was signed rather than opened for signature uses the word signed.
  • Amendment form: the original citation, a comma, as amended by in roman lower case, then the full chapter 8 citation of the amending treaty.
  • A pinpoint to the original treaty goes before the comma and as amended by; a pinpoint to the amending treaty goes at the end.
